Sales made via this online store presuppose the acceptance by the customer of the General Conditions of Sale that are established in compliance with the legislation applicable to the e-commerce sector.

Outros Montes/DSUN reserves the right to change these General Conditions of Sale without prior notice and is obliged to publish any changes to this website.

I. General Conditions of Sale

1 – Products

All the products presented at the website contain detailed information, descriptions and prices. However, there may be situations where product information, including pricing and promotional campaigns, has not been correctly published. In these cases, Outros Montes/DSUN reserves the right not to fulfill orders containing the respective products. In the event that an order containing such products has been placed, the Customer Support team will contact the customer in order to inform of the impossibility to proceed with the order.

All products, campaigns, promotions and offers are limited to the effective available stock and / or limited units determined for each campaign.

2 – Ordering and Purchasing Process

Upon completion of the ordering process in the customer's personal account, the purchase will be registered and the customer will have a deadline, indicated in the payment method selected, to proceed to the payment. At the end of this period, if there is no confirmation of payment, the order will be cancelled. 

Outros Montes/DSUN offers the following payment methods for purchases made through the online store:

a) Bank transfer

Bank transfer must be made to the following IBAN:

(SWIFT CGDIPTPL- in case of a transfer from abroad), it is necessary to send proof of payment to the email encomendas@outrosmontes.pt, together with the respective proforma invoice number.

The shipment will only be made after good collection.

b) ATM

ATM payments can be made through the ATM network or through Homebanking.

Once the order is completed, an ATM reference will be generated. The customer will receive this reference in the order confirmation email

To pay at an ATM, the customer shall select the "Payment for Services / Purchases" option and enter the corresponding entity, reference, and amount.

The order will predictably be shipped on that same day if payment is made before 2 p.m. of a business day. Orders paid at a later time will, predictably, be shipped on the following business day. The order will remain active for 48 hours waiting for payment, after that period, in case of non-payment, it will be cancelled.

c) MB Way

The order will be shipped the following business day after receipt, if payment is made before 2 pm on a business day.

If Outros Montes does not receive payment for the order within the following 2 days, the order will be cancelled.

3 – Delivery Process

1. Once the order has been shipped, the customer will receive a confirmation email with their invoice, the assigned shipping number and a hyperlink that will allow the tracking of the order on the carrier's website. 

Attempting to track the order online upon receipt of the shipment confirmation email may not return any results. Shipping information may take up to 24 hours from receipt of shipment confirmation to be updated on the carrier's website.

Orders are delivered from Monday to Friday, except for local or national holidays, at the address indicated by the customer when placing the orders.

Warning:

- It is not possible to choose a specific delivery time as it will be conditioned by the courier route on the day of delivery, which is exclusively set by the transport service.

The indication of an incorrect or incomplete delivery address may result in the order being returned to Outros Montes/DSUN and may lead to additional costs for the customer; for this reason, it is highly recommended that the customer always makes sure that the delivery address indicated at the time of the order placement is effectively correct and complete. Once the order is placed, it is not possible to change the delivery address or the provided billing data.

b) Shipping costs

Shipping costs are automatically calculated by the system and may vary accordingly to the following circumstances:

- actual or volumetric weight (whichever the higher);

- total amount of the order;

- carriers' pricing fees, which are subject to regular updates.

Shipping costs are automatically updated as the products are added to the shopping cart.

c) Order Receipt

At the time of delivery, the customer must always verify that the outside state of the order box presents visible damage. If there is visible external damage, we appreciate that you reject the order, or accept it by marking reservations, writing on the Delivery List/Transport Guide (signature registration equipment), any of the following options: open packaging, torn, dented, perforated, wet, etc.). Further inform you of the delivery procedures, that the recipient customer may not open the packaging without their signature on the distributor's list in which he prescribed them, however, may place reservations describing for each object number what damage or incidence he/she/she has verified on the packaging (as mentioned above, in the case of the order presenting visible damage).

4 – Order Cancellation , Return and Exchange Procedure

a) The customer can only cancel the order prior to the respective payment and processing. If that should be the case, cancellation should be requested by choosing the "Orders" option, available in the personal area of the customer account. . Order cancellation is only possible through the abovementioned process. Any similar request made by other means cannot be fulfilled.

b) In case of loss of the order, or impossibility of delivery to the recipient, the anomaly detection service may take up to 14 working days to confirm the occurrence. During this period no refund can be made.

c) In the event that a paid order is returned to Other Montes/BSUN, for reasons not attributable to Other Montes/DSUN or the carrier, Outros Montes/DSUN will not refund the total amount paid.

If the reason for the delivery is not obtained and return of the order may be the responsibility of the freighter, regardless of the payment method chosen, the customer will have to send us a written complaint that will be subsequently reviewed by the carrier. In case the delivery problem was caused by an incorrect or incomplete address, we ask that the customer attach a proof of address (e.g. electricity, water or gas account) to the complaint. The solution that Outros Montes/BSUN will present to the customer will depend on the response given by the carrier. Thus, in cases of complaints arising from the transport service, we will only be able to present a solution to the customer after we obtain a response from the carrier. If the carrier accepts full responsibility for the return of the order and if all items originally ordered are available, we will suggest to the customer the resubmission at no additional cost or reimbursement of the amount paid.

If the carrier does not accept the responsibility, we will not be able to accept the claim, which means that the refund will be subject to the above mentioned terms relating to the orders returned for reasons not attributable to Outros Montes/BSUN or the carrier.

d) If the customer wishes to return one or more items, he may do so within 14 days of receipt of the order, provided that the products are intact, sealed, complete and inside the original packaging, which may not be damaged, altered or scratched . The customer must ensure that the article(s) returned(s) arrives at our facilities within 28 days of their delivery.

To exercise their right of return, the customer must contact our Customer Service, specify the order number, description or reference of the product(s) that wish to return.

The customer will also have to keep in mind whether the product intended to return was purchased under some promotional campaign and if, for that reason, he benefited from any offer product. If this has been the case, the customer must return not only the product in question, but also the offer assigned with the purchase. Both products must comply with the above mentioned guidelines.

As per the products set in packs, it will only be accepted the return of the full packs. If a product that belongs to a pack is to be returned, all the products belonging to the same pack must be returned. All products must comply with the abovementioned conditions of return.

Incomplete, damaged or scratched products, products without their original packaging and/or label, or products with evidence of use, will not be accepted, as well as the return of products with a shelf-life less than one month

If any item is not received under the abovementioned conditions or with a shipping label attached directly to the packaging, the customer will lose the right to be refunded and will have 10 days to collect the item (s) at the said facilities, at their own expenses.

IMPORTANT: Under no circumstances will you send the items without prior contact because they will not be received.

5 – Refunds

a) If the reason for the return of the order was the responsibility of Outros Montes/DSUN, we will refund the entire amount paid by the customer (example: defective products or error in the processing of the order).

However, if in an order for multiple products, only one party has presented any problems, we will not refund shipping costs.

b) Non-delivery of the order for reasons attributable to Outros Montes/BSUN or the carrier: the customer will be fully refunded of the amount which he may have paid as shipping charges.

II - Privacy and Data Protection Policy

Browsing the Outros Montes/DSUN website and customer registration on the online store requires the acknowledgment and the acceptance of this Privacy and Data Protection Policy.

Outros Montes/DSUN maintains a constant concern for the protection of the privacy of personal data and a preventive action regarding the security of the site and the protection of the data of its customers and visitors.

a)User registration: creation of the Outros Montes/BSUN customer account and data processing purposes

For the purpose of creating the customer account, a personal area is made available where the customer must enter the data necessary for their identification as a customer. The first purchase will depend on the provision of additional personal data, indispensable to the processing of the order and its delivery. Optional fill fields in the forms available for those registration phases are marked with an asterisk (*).

Outros Montes/DSUN undertakes to protect customer data and they will never be made available to third parties without the knowledge or consent of the holder, as is legally chargeable.

In addition, when making a purchase on the website, data relating to the delivery address and payment details will also be requested in order to ensure the greatest possible effectiveness and compliance with delivery times.

The data provided will be stored for a strictly necessary period which normally corresponds to the period of existence of the customer account. For this reason, at the time when the customer triggers the cancellation of the customer account, personal data will be permanently deleted, with reservation of the data necessary to comply with legal obligations that will be archived in its own database for this purpose effect and for the absolutely necessary time. If you wish to place a new order on the site, the customer must make a new initial registration and shall be subject to the terms and conditions in force at the date of the same.
